Researchers interested in children's understanding of mind have claimed that the ability to ascribe beliefs and intentions is a late development, occurring well after children have learned to speak and comprehend the speech of others. On the other hand, there are convincing arguments to show that verbal communication requires the ability to attribute beliefs and intentions. Hence if one accepts the findings from research into children's understanding of mind, one should predict that young children will have severe difficulties in verbal (...) communication. Conversely, if this prediction fails, this casts doubt on the claim that young children lack meta-representational skills. Using insights from Relevance Theory, an experiment was designed to test children's ability to recover a speaker's intended referent in situations in which the speaker's words underdetermine the referent. Results suggest that children's skills are comparable to those of untutored adults in similar situations. Thus this study indirectly casts doubt on the claim that young children lack meta-representational skills. (shrink)

Surgical devices are often marketed before there is good evidence of their safety and effectiveness. Our paper discusses the ethical issues associated with the early marketing and use of new surgical devices from the perspectives of the six groups most concerned. Health Canada, which is responsible for licensing new surgical devices, should amend their requirements to include rigorous clinical trials that provide data on effectiveness and safety for each new product before it is marketed. Industry should comply with all Health (...) Canada requirements to obtain licenses for new products. Until Health Canada requires effectiveness and safety data, industry should cooperate with physicians in appropriate studies before releasing new products and should make balanced presentations of all the available evidence. Surgeons should, before using a new surgical device, assess the evidence on its effectiveness and safety and ensure they are properly trained and competent in using the device. Surgeons should provide their patients with an evaluation of the available evidence and inform them about possible complications and the surgeon's level of experience with the new device. Patients, who should be given an honest evaluation of the available evidence, possible complications, and the surgeon's experience, should be encouraged to evaluate the evidence and information to their own satisfaction to ensure that fully informed consent is given. Health institutions, responsible for regulating practice within their walls, should review new devices for safety, effectiveness, and economic impacts, before allowing their use. They should also limit the use of new surgical devices to surgeons trained and competent in the new technology. Professional societies should provide guidance on the early adoption of new surgical devices and technologies. We urge all those involved in the development, licensing, and use of new surgical devices to aim for higher ethical standards to protect the health and safety of patients requiring surgery. The lowest acceptable ethical standard would require device manufacturers to provide surgeons with accurate and timely information on the efficacy and safety of their products, allowing surgeons and patients to evaluate the evidence (and the significance of information not yet available) before surgery. Family Medicine Groups (FMGs) are the most recently developed primary care organizations in Quebec (Canada). Nurses within FMGs play a central role for patients with chronic diseases (CD). However, this complex role and the nursing activities related to this role vary across FMGs. Inadequate knowledge of nursing activities limits the implementation of exemplary nursing practices. This study aimed to describe FMG nursing activities with patients with CD and to describe the facilitators and barriers to these activities. A multiple‐case study was (...) performed with ten nurses practicing among patients with CD in FMGs. Five data sources were used to provide an in‐depth description of nursing activities and the facilitators and barriers to the development of these activities. After qualitative data analysis, findings show that nursing activities are clustered into five domains: Global assessment of the patient, Care management, Health promotion, Nurse–physician collaboration, and Planning services for patients with CD. Activities vary depending on contextual factors identified in each case. This multiple‐case study provides a clear description of nursing activities with patients with CD. There is a need for improved nursing activities and expertise in domains of activities that are less present in FMGs, such as case management and interprofessional collaboration. (shrink)

This paper describes a discourse analysis of the process of interpersonal psychotherapy (IPT) in the recovery from depression. It demonstrates how IPT is an effective treatment strategy for mental health nurses to utilise in the treatment of depression. The discourse analysis highlights how the development of more meaningful subject positions enables one woman to recover from her depression. The process of recovery is underpinned by an understanding of women's depression as promoted by contemporary social and cultural expectations for detachment and (...) reflexivity. This paper shows how IPT provides an opportunity for recovery from depression for one woman by facilitating a reconstruction of her subject positions in relation to others. The discourse analysis revealed that the therapist facilitated this through the use of a range of techniques: seeking information, exploring beliefs/values/assumptions, exploring communication patterns, exploring affective responses and exploring alternative subject positions. Using a Girardian hermeneutic as a starting point, a new conceptual Gestalt emerges in these essays, one not fully integrated in a formal way but showing a clear understanding of some of the challenges and possibilities for dealing with the deep divisions, enmity, hatred, and other effects of violence. By situating (...) discourse about reconciliation within the context of Girardian thought, it becomes clear that like Peter who vowed he would never deny Jesus but ended up doing it three times any of us is susceptible to the siren call of angry resentment and retaliation. In times encouraging of women, Taylor Mill is regarded as having made important contributions to the development of J. S. In less encouraging times, her significance tends to be minimized.Hannah Arendt is not usually thought of as a feminist. It suggests that a philosophical openness to thinking about nature, about our human relationships, capacities, concepts, and conceptual scheme would enable a constructive feminist perspective on natural theology. Topics discussed include the feminist challenge to the western tradition of natural theology; myth, absolute truth, and male supremacy; sexual difference, transcendence, and religious epistemology. L’intégration des technologies de l’information et de la communication (TIC) à l’apprentissage représente une avenue explorée à la fois par les milieux scientifique, institutionnel et scolaire afin de développer des environnements éducatifs stimulants pour les apprenants. Au Québec, L’École en réseau, un projet d’innovation technologique rassemblant 23 commissions scolaires et près d’une centaine d’écoles majoritairement de l’ordre primaire (6 à 12 ans), a mis entre autres en place le forum de coélaboration de connaissances (FCC) pour répondre à certains besoins émergents (...) de professionnels de l’éducation en matière d’avancées technopédagogiques ainsi qu’à ceux des apprenants baignant aujourd’hui dans la culture du numérique. Cette plateforme propose entre autres un espace de collaboration sous forme de discours écrit asynchrone dans lequel chaque élève collabore et construit sa compréhension d’un phénomène, d’un problème à résoudre ou d’un texte dans le cadre de multiples activités liées à différentes matières scolaires. Les participants – élèves, enseignants et conseillère pédagogique – sont amenés à écrire des textes, de longueur et de type divers, à les annoter, à les améliorer et à les enrichir à l’intérieur d’une base de connaissances qui conserve les traces de leurs échanges sous forme de toile interactive. Cet article traite du potentiel de documentation du FCC qui permet aux utilisateurs, soit les élèves, les enseignants, les conseillers pédagogiques, voire les chercheurs, de visualiser les activités, les progrès et les habitudes d’utilisation de chacun sous différents angles grâce à ses diverses fonctionnalités. Les traces laissées par la communication asynchrone facilitent en effet, selon Gikand, Morrow et Davis (2011), l’auto-évaluation de la compréhension qu’ont les élèves du contenu en plus de leur permettre le partage de questionnements ainsi qu’une réflexion sur leur contribution aux discussions sur le forum. Le potentiel relié à l’archivage de différentes données d’un forum, tel que défini par Heinrich, Milne et Moore (2009), permet l’analyse statistique et le profilage d’élèves afin de mieux répondre à leurs besoins en tant qu’apprenants. Aussi, l’analyse des interactions (posting behaviours) et suivis de fréquentation sur la plateforme (non-posting behaviours) peut amener les enseignants et les élèves à réfléchir sur leurs pratiques et diriger leurs interventions pédagogiques (Xie, 2013). Par ailleurs, la notion de transparence comme la définissent Lafuente Martínez et al. (2015), appliquée au FCC, est également présentée ici. Celle-ci comprend les échanges entre les élèves durant la réalisation de l’activité d’apprentissage et d’évaluation : les versions antérieures du travail tout au long de la réalisation de la tâche d’écriture et tout élément témoignant de leur processus réflexif (plans, notes, schémas, etc.). Cette mise en disponibilité du brouillon des textes des élèves représente une opportunité de documenter la progression des apprentissages de l’apprenant et d’exploiter le potentiel d’autorégulation de l’évaluation formative (Pachler, Daly, Mor, Mellar, 2010). Enfin, la possibilité de suivre l’évolution de la pensée critique de l’apprenant, à savoir si celui-ci, par ses interventions sur les textes des autres, propose des commentaires qui favorisent le dialogue et qui amènent des éléments de réflexion pour faire progresser les discussions (Olofsson, Lindberg, Stödberg, 2011) est mise en relief à l’aide des interventions des élèves, recueillies à même la plateforme. The paper builds on the postulate of “myths we live by,” which shape our imaginative life (and hence our social expectations), but which are also open to reflective study and reinvention. It applies this principle, in particular, to the concepts of love and vulnerability. We are accustomed to think of the condition of vulnerability in an objectifying and distancing way, as something that affects the bearers of specific (disadvantaged) social identities. Against this picture, which can serve as a pretext for (...) paternalist and controlling attitudes to the groups in question – notably to women – Anderson urges us to reimagine our vulnerability as a condition not merely of exposure to violence but of openness to mutual affection, love, and friendship. Hegel’s celebrated image of the owl of Minerva, which takes wing only with the coming of dusk, suggests an association of (philosophical) wisdom with negativity – with the experience of death or loss. Anderson, by contrast, proposes an alternative and more hopeful image of the dawn of enlightenment, in the guise of new ethical dispositions shaped by an emancipatory (and so, no longer an oppressive or sexist) conception of our capacity for love. Her main interlocutors or influences in this piece are Judith Butler (who contributes the idea of a “relational ontology”), Michèle Le Doeuff, and Mary Midgley. (shrink)

Improving how health care providers respond to medical injury requires an understanding of patients’ experiences. Although many injured patients strongly desire to be heard, research rarely involves them. Institutional review boards worry about harming participants by asking them to revisit traumatic events, and hospital staff worry about provoking lawsuits. Institutions’ reluctance to approve this type of research has slowed progress toward responses to injuries that are better able to meet patients’ needs. In 2015–2016, we were able to surmount these challenges (...) and interview 92 injured patients and families in the USA and New Zealand. This article explores whether the ethical and medico‐legal concerns are, in fact, well‐founded. Consistent with research about trauma‐research‐related distress, our participants’ accounts indicate that the pervasive fears about retraumatization are unfounded. Our experience also suggests that because being heard is an important (but often unmet) need for injured patients, talking provides psychological benefits and may decrease rather than increase the impetus to sue. Our article makes recommendations to institutional review boards and researchers. The benefits to responsibly conducted research with injured patients outweigh the risks to participants and institutions. (shrink)

Pamela Sue Anderson’s project about vulnerability and the silencing of the female speaker began with her realization of the female philosopher’s position within academia. Exposing the disavowal of the female “knower,” Anderson lays bare the mechanisms of excluding women from intellectual, artistic and religious discourse. Moving beyond the negative configuration of vulnerability associated with an openness to violence, Anderson refigures it as an openness to affection. The denial of thus refigured vulnerability has led to the literal and discursive oppression of (...) women through the “wilful ignorance” of their intellectual, emotional and sexual needs. In this article Filipczak analyses manifestations of this oppression exposed by female writers who illustrate the predicament discussed by Anderson in their fiction. Starting with Anderson’s refiguring of Antigone as a figure of dissent and marginality in her early work, Filipczak discusses Maggie Tulliver from The Mill on the Floss by George Eliot, Morag Gunn from The Diviners by Margaret Laurence and Mary Magdalene from The Secret Gospel of Mary Magdalene by Michèle Roberts. What connects these characters is the fact that they are disavowed as knowers in intellectual, artistic or theological endeavours by male figures of authority who deny vulnerability as an openness to affection, and rely on social collusion with such denial. Expecting Saving Mr. Banks to be a jolly jaunt about the creative development of the movie Mary Poppins (1964), I found myself waiting endlessly for the “jolliness” to begin—it never did. In fact, rather than joy, there was an ever-present sensation of tension as I watched the film. Having moved house myself in recent days (during a Queensland heat wave), the scenes of the Goff family leaving their home and trekking across hot, dusty Queensland were very emotional. However, seeing (...) the family patriarch Travers Goff (played by Colin Farrell) swig from an alcohol flask in a desperate manner told me that his was no “routine” family move. And, certainly, arriving at their destination—a dilapidated ranch home—shed even more light on the Goff family’s predicament: alcoholism and the cycle of employment and unemployment. Further, it is the downstream consequences of the family predicament that fuel the identity and behaviour of Mary Poppins—a fictional character created by Travers’ daughter, a. (shrink)

A Tennessee trial court termed Mary Sue and Junior Davis's frozen embryos “in vitro children” and applied a best-interests standard in awarding “custody” to Mary Sue Davis; the Warnock Committee drew an implicit analogy between human gametes and transplantable organs in its recommendation of a (...) voluntary, nonprofit system for collecting and distributing gametes in the United Kingdom; Owen Jones compares the right to trait-selection to the right to abortion; Robert Veatch once claimed that if a woman had signed an organ donation card and then died while pregnant, she had in effect given consent to the attempt to sustain the pregnancy after her death; John Robertson has argued that contract pregnancy poses no problems we have not already encountered with adoption; and Andrea Bonnicksen has compared the wonders of preembryonic genetic screening to the riches housed in the gold museum in Bogota, Colombia. For my invited contribution to this special issue of Religions on “Feminisms and the Study of ‘Religions,’” I focus on philosophy of religion and contestations over its relevance to the academic field of Religious Studies. I amplify some feminist philosophers’ voices—especially Pamela Sue Anderson—in corroboration with recent calls from Religious Studies scholars to diversify philosophy of religions in the direction of locating it properly within the current state of Religious Studies. I want to do this by thinking through two proposals (...) in productive tension: first, any philosophy of religions worthy of the name is intrinsically feminist; second, any philosophy of religions worthy of the name is intrinsically traditional. I want to use the productive tension between these two to illuminate ways calls for broadening the field can be enhanced when such calls are seen as both feminist and traditional. I proceed as follows. First, I note three instances of explicitly feminist work in philosophy of religions that do not suffer from the same narrowness as so-called “traditional” philosophy of religion. Religious Studies critics of philosophy of religion overstate the case in claiming feminist philosophy of religion is too narrow. Second, I develop a useful distinction between the concepts of “tradition” and “institution” to locate forces of oppression more precisely in dynamics of institutionalization so that we might rehabilitate tradition as a resource for combating institutionalized oppressiveness. I do this in response to the hegemony of current philosophers of religion who claim to speak about “the traditional god.” And third, I briefly coordinate four topics in religions from diverse feminist perspectives to help refine paths of inquiry for future philosophy of religions that is both feminist and traditional. My hope is that these clarify a philosophy of religions renewed through feminisms—moving from fringe to normative topics in institutionalized philosophy of religion, maintaining focus on actually existing human beings rather than hypothetically existing transcendent entities. I turn our attention to technical issues surrounding the status of mae chis, Buddhist laity who seek monastic recognition in Theravada. I turn our attention to struggles over fitting criteria for leadership between Mary Magdalene and Peter in early Christian contexts. I have us listen to Muslim women who seek to speak for themselves, many of whom describe Muhammad as a feminist. I have us listen to Anderson’s criticism of arguments about the (non)existence of a god and her promotion of human yearning as guided by regulative ideals as a pointed challenge to institutionalized philosophy of religion. In all these ways and more, feminist challenges to institutionalized philosophy of religion further contribute to diversifying field. (shrink)

Many ethical frameworks require artificial intelligence (AI) systems to be explainable. Explainable AI (XAI) models are frequently tested for their adequacy in user studies. Since different people may have different explanatory needs, it is important that participant samples in user studies are large enough to represent the target population to enable generalizations. However, it is unclear to what extent XAI researchers reflect on and justify their sample sizes or avoid broad generalizations across people. We analyzed XAI user studies (N = (...) 220) published between 2012 and 2022. Most studies did not offer rationales for their sample sizes. Moreover, most papers generalized their conclusions beyond their target population, and there was no evidence that broader conclusions in quantitative studies were correlated with larger samples. These methodological problems can impede evaluations of whether XAI systems implement the explainability called for in ethical frameworks. We outline principles for more inclusive XAI user studies. Why should anybody take an interest in philosophy? Is it just another detailed study like metallurgy? Or is it similar to history, literature and even religion: a study meant to do some personal good and influence our lives? In her last published work, Mary Midgley addresses provocative questions, interrogating the various forms of our current intellectual anxieties and confusions and how we might deal with them. In doing so, she provides a robust, yet not uncritical, defence of philosophy and (...) the life of the mind. This defence is expertly placed in the context of contemporary debates about science, religion, and philosophy. It asks whether, in light of rampant scientific and technological developments, we still need philosophy to help us think about the big questions of meaning, knowledge, and value. (shrink)

The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

BackgroundA key ethical question in genomics research relates to whether individual genetic research results should be disclosed to research participants and if so, which results are to be disclosed, by whom and when. Whilst this issue has received only scarce attention in African bioethics discourse, the extension of genomics research to the African continent has brought it into sharp focus.MethodsIn this qualitative study, we examined the views of adolescents, parents and caregivers participating in a paediatric and adolescent HIV-TB genomic study (...) in Botswana on how solidarity and reciprocity obligations could guide decisions about feedback of individual genetic research results. Data were collected using deliberative focus group discussions and in-depth interviews.ResultsFindings from 93 participants demonstrated the importance of considering solidarity and reciprocity obligations in decisions about the return of individual genetic research results to participants. Participants viewed research participation as a mutual relationship and expressed that return of research results would be one way in which research participation could be reciprocated. They noted that when reciprocity obligations are respected, participants feel valued and not respecting reciprocity expectations could undermine participant trust and participation in future studies.ConclusionsWe conclude that expectations of solidarity and reciprocity could translate into an obligation to feedback selected individual genetic research results in African genomics research. Background There is considerable variation in the functionality of bioethical services in different institutions and countries for children in hospital, despite new challenges due to increasing technology supports for children with serious illness and medical complexity. We aimed to understand how bioethics services address bioethical concerns that are increasingly encountered in paediatric intensive care. Methods A qualitative descriptive design was used to describe clinician’s perspectives on the functionality of clinical bioethics services for paediatric intensive care units. Clinicians who were members (...) of formal or informal clinical bioethics groups, or who were closely involved with the process of working through ethically challenging decisions, were interviewed. Interviews took place online. Resulting transcripts were analysed using thematic analysis. Results From 33 interviews, we identified four themes that described the functionality of bioethics services when a child requires technology to sustain life: striving for consensus; the importance of guidelines; a structure that facilitates a time-sensitive and relevant response; and strong leadership and teamwork. Conclusions Clinical bioethics services have the potential to expand their role due to the challenges brought by advancing medical technology and the increasing options it brings for treatment. Further work is needed to identify where and how bioethics services can evolve and adapt to fully address the needs of the decision-makers in PICU. (shrink)

The decision of the House of Lords in Gillick v West Norfolk Area Health Authority carved out a safe space for competent minors to confidentially access sexual and reproductive health care and advice in the UK. Ireland is one of the few common law jurisdictions that has not endorsed Gillick or a similar mature minor doctrine, nor has it securely legislated for the right to consent of those aged 16 and 17 years. The legal lacuna created by this deficiency has (...) left young persons in Ireland seeking sexual and reproductive healthcare, and the clinicians who provide this, in a challenging place. While this void has been partially filled with policy statements by bodies such as the Irish College of General Practitioners and the Health Service Executive, nonetheless the legal shortcomings leave both a sense of insecurity, and real world difficulties for adolescents seeking to access to sexual and reproductive healthcare. Recently, concerns have been raised about the phenomenon of 'overdiagnosis', the diagnosis of a condition that is not causing harm, and will not come to cause harm. Along with practical, ethical, and scientific questions, overdiagnosis raises questions about our concept of disease. In this paper, we analyse overdiagnosis as an epistemic problem and show how it challenges many existing accounts of disease. In particular, it raises questions about conceptual links drawn between disease and dysfunction, harm, and risk. We argue that (...) "disease" should be considered a vague concept with a nonclassical structure. On this view, overdiagnosed cases are 'borderline' cases of disease, falling in the zone between cases that are clearly disease, and cases that are clearly not disease. We then develop a précising definition of disease designed to provide practical help in preventing and limiting overdiagnosis. We argue that for this purpose, we can define disease as dysfunction that has a significant risk of causing severe harm to the patient. (shrink)

In the study of gender and society, science is a strategic analytic research site—because of the hierarchical nature of gendered relations, generally, and the hierarchy of science, particularly. Academic science, especially, is crucial to, and revealing of, status in science and society. This article focuses on three questions: What is the status of women in scientific careers and the role of graduate education in these careers? What are the implications for the analysis of gender? Where can we intervene, and how? (...) In addressing these questions, the arguments concentrate on the social and organizational context of science and its relationship to gender and status. This article examines the issues that are at stake in the current resurgence of interest in the subject of habit. We focus on the role that habit has played in conceptions of the relations between body and society, and the respects in which such conceptions have been implicated in processes of governance. We argue that habit has typically constituted a point of leverage for regulatory practices that seek to effect some realignment of the relations between different components of personhood – (...) will, character, memory and instinct, for example – in order to bring about a specific end. In reviewing its functioning in this regard across a range of modern disciplines – philosophy, psychology, sociology – we explore the tensions between its use and interpretation in different lineages: in particular, the Cartesian–Kantian/ravaisson–bergson–deleuze lineages.
